Top UN Court Demands Israel Cease Rafah Offensive Immediately

The United Nations’ top court has ordered Israel to cease its offensive in the Gaza Strip’s southern city of Rafah, where the Israeli military suspects Hamas leaders and operatives may be hiding.

The International Court of Justice, located in the Hague, voted 13 to 2 on Friday for Israel to “immediately halt its military offensive and any other action in the Rafah governorate.” This ruling came after South Africa accused Israel of committing genocide.

According to the court, Israel must stop operations in Rafah that could bring about the physical destruction of the Palestinian group in Gaza. The ruling also mandates that Israel keep the Rafah crossing open for the provision of urgently needed basic services and humanitarian assistance.

Israel launched its operation in Gaza last October in response to a surprise attack by Hamas, resulting in the deaths of at least 1,200 people, primarily civilians, and the abduction of over 240 individuals. The Israeli government seeks to eliminate Hamas and secure the release of hostages.

The Hamas-run Gaza Health Ministry claims that over 35,000 people have been killed since the offensive began. However, Israel denies the charges of genocide and vows to continue efforts to enable humanitarian assistance while complying with the law to minimize harm to the civilian population in Gaza.

Despite the ICJ’s order, some argue that Israel is within its rights to continue its operation in Rafah with modifications to ensure compliance with the Genocide Convention. The decision has sparked controversy and condemnation from human rights advocates, who view it as a setback for justice and a boon for Hamas.
