Family files lawsuit against Hawaii resort following tourist’s sudden death while snorkeling

A tragic incident in Maui has left a Michigan woman questioning the circumstances surrounding her husband’s death while snorkeling. Patricia Johnson and her family are suing a Maui resort, the Hawaiian Tourism Authority, and the Hawaii Visitors and Convention Bureau after her husband, Ray Johnson, passed away during a snorkeling excursion.

The couple, along with friends, had arrived at the Fairmont Kea Lani on Maui for a vacation. On the morning of February 25, Ray went snorkeling at Wailea Beach while Patricia stayed on shore. Tragically, Ray encountered difficulties in the water and despite efforts to rescue him, he did not survive.

The autopsy report ruled Ray’s death as an accidental drowning, but Patricia believes there is more to the story. She suspects that a medical condition called Rapid Onset Pulmonary Edema (ROPE) may have played a role in her husband’s death. ROPE is a condition where negative pressure on the lungs causes bodily fluids to be pulled into the airways, leading to breathing difficulties and potentially fatal consequences.

The Johnson family’s lawsuit alleges that Hawaii travel entities have not adequately educated the public about the risks of ROPE while snorkeling, leading to a “public health concern.” The case is set to begin the fact-discovery process this week.

This tragic incident sheds light on the dangers of snorkeling and the importance of being aware of potential medical conditions that can arise in the water. The Johnsons hope that their lawsuit will bring attention to the risks associated with snorkeling and prevent future tragedies.
