Former B.C. couple ordered by judge to share custody of dog Stella

In a groundbreaking decision, a B.C. judge has granted joint custody of a golden retriever named Stella to a former couple, Sahar Bayat and Omid Mavedati. The dispute over ownership arose as only Mavedati’s name was on Stella’s birth certificate, but Bayat had also contributed financially to the dog’s purchase.

Associate judge Scott Nielsen acknowledged the love both parties had for Stella and their concern for her well-being. The judge ultimately ruled for a 50/50 custody arrangement, with Stella spending one week with each owner on a rotating basis.

This ruling comes on the heels of changes to the Family Law Act in B.C. that recognize pets as more than just property. Animal law lawyer Rebeka Breder, who has been involved in pet custody battles for 15 years, emphasized the importance of considering the pet’s best interests in such cases.

The court must now consider various factors when determining pet custody, including the care each spouse provided to the animal, any history of cruelty, and the pet’s relationship with any children involved.

Breder suggested that exes seeking pet custody arrangements can start by going to small claims court rather than escalating the matter to the Supreme Court. Despite attempts to reach out to both owners for comment, no response was received by the deadline.

This case sets a precedent for future pet custody disputes, highlighting the evolving recognition of pets as valued members of the family in legal proceedings.
