Harvey Weinstein is set to make a dramatic return to court on Wednesday after his 2020 rape conviction was overturned by an appeals court last week. The disgraced former Hollywood producer will appear in a New York courtroom for the first time since the decision was made to order a new trial.

Weinstein’s attorney, Arthur Aidala, confirmed that the preliminary hearing in Manhattan will cover various matters such as evidence and scheduling. Despite being hospitalized shortly after his return to the city jail system, the 72-year-old will attend the hearing. Aidala cited Weinstein’s health issues, including cardiac problems and diabetes, as the reason for his hospitalization.

Manhattan District Attorney Alvin Bragg’s office has expressed its determination to retry the case against Weinstein. Legal experts believe that the success of a retrial may hinge on whether the women accusing him of assault are willing to testify again. One of the accusers, Mimi Haley, stated that she is still considering whether to testify in a retrial.

Weinstein, who was also convicted of rape in Los Angeles in 2022 and sentenced to 16 years in prison in California, was previously convicted in New York of rape in the third degree and sexual assault. The Court of Appeals’ decision to overturn his conviction and vacate his 23-year prison sentence has sparked shock and disappointment among supporters of the #MeToo movement.
