IFA Unveils Guidelines for Ethical Franchising Practices

The International Franchise Association (IFA) has taken a significant step towards promoting responsible franchising by releasing recommendations to enhance transparency in the sales process. This move comes in response to a growing grassroots movement within the industry.

According to IFA president and CEO Matthew Haller, robust pre-sale disclosure is essential for establishing clear expectations between brands and franchisees at the beginning of a long-term relationship. One of the key recommendations for franchisors is to shift towards a conversational, Q&A style of disclosure in the franchise disclosure document (FDD). This document, consisting of 23 items, provides detailed information about the franchisor and the franchise opportunity to help prospective franchisees make informed decisions. The IFA also suggests adding an executive summary, using multimedia, and presenting information in a more accessible format.

For franchisees, the IFA emphasizes the importance of due diligence before making any investment. This includes comparing multiple brands, reading the FDD, and consulting with a franchise attorney. Additionally, franchisees are advised to validate opportunities through interviews with existing franchisees and understand the risks associated with business ownership.

The IFA’s recommendations for third-party sellers include disclosing their professional experience, litigation history, services performed on behalf of franchises, and more.
