Judge declares Alaska correspondence school reimbursements unconstitutional

An Anchorage Superior Court judge made a groundbreaking ruling on Friday, declaring that correspondence schools in Alaska that reimburse parents for their children’s education-related expenses are unconstitutional. This decision could have significant implications for the nearly 20,000 correspondence school students in the state and the public education system as a whole.

Correspondence programs in Alaska allow students to be homeschooled under the authority of local school districts, with families receiving reimbursements for education-related expenses using public funds. However, in a lawsuit filed last year, four parents and teachers challenged the statute enabling these reimbursements, arguing that it violated the state constitution by essentially funneling public money to private educational institutions.

Judge Adolf Zeman agreed with the plaintiffs, deeming the statutes supporting the correspondence allotments “facially unconstitutional” and ordering them to be struck down entirely. This decision has sparked concerns among lawmakers and officials, with Deputy Attorney General Cori Mills calling it “very concerning.”

The ruling has left the fate of correspondence programs uncertain, with questions arising about whether students can continue using their allotments in the current school year. Attorney Scott Kendall, representing the plaintiffs, emphasized the need for the legislature to act swiftly to address the issue and ensure the programs can operate within constitutional boundaries.
