Portland’s Struggle with Airbnb Regulation: A Cautionary Tale

Portland, Oregon, has been at the forefront of regulating short-term rentals like Airbnb for the past decade. However, a recent report from The Oregonian has shed light on the city’s ongoing struggle to enforce these regulations effectively.

Ten years ago, Portland implemented a requirement for owners of short-term rentals to obtain a license for their properties. Despite this, Airbnb failed to remove listings that did not comply with the law. In 2019, Portland demanded better data sharing from Airbnb to cross-reference licensed rentals with properties listed on the platform. However, the city lacked the resources and technical expertise to effectively use the data provided by Airbnb, leading to hundreds, possibly over 1,000, unlicensed rentals operating illegally.

The lack of enforcement has raised concerns among housing advocates in Portland. Lauren Everett from Portland Tenants United highlighted the impact of illegal Airbnbs on the city’s housing supply, stating that it allows people to use houses as hotels, further exacerbating the affordable housing crisis.

Safety is another major concern with unregulated short-term rentals. Portland’s official licensing process includes a safety inspection, but due to a backlog, only 14 inspections have been conducted since 2019. This means that the majority of rentals are operating without proper safety oversight, posing potential risks to guests.

Portland’s struggle with Airbnb regulation serves as a cautionary tale for other cities facing similar challenges. Cities like Santa Barbara and Los Angeles are also grappling with illegal rentals, emphasizing the need for effective enforcement strategies. Some advocates suggest holding Airbnb accountable for enforcement, as they profit from these communities.
